These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", or "your") and CareCub ("Company", "we", "us", or "our") regarding your access to and use of the CareCub application and related services (collectively, the "Service").

By accessing, downloading, installing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you are expressly prohibited from using the Service and must discontinue use immediately.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service following any changes constitutes acceptance of such changes.

2. Service Description and Scope

CareCub is a Progressive Web Application (PWA) designed to assist parents and caregivers in organizing and tracking infant and child care activities. The Service provides digital tools for:

• Recording feeding sessions, including breastfeeding and bottle feeding
• Logging diaper changes and related observations
• Tracking sleep patterns and duration
• Storing notes and observations about child care activities
• Generating reports and summaries of tracked data
• Synchronizing data across multiple devices

The Service is strictly a data organization and tracking tool. It does not provide medical advice, healthcare services, or professional consultation of any kind.

3. User Eligibility and Account Requirements

Age Requirement: You must be at least 18 years of age to create an account and use the Service. By using the Service, you represent and warrant that you meet this age requirement.

Account Registration: To access certain features, you must create an account by providing accurate, current, and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Immediately notifying us of any unauthorized use of your account
• Ensuring all information provided is accurate and up-to-date

Parental Authority: You represent that you have the legal authority to make decisions regarding the care of any children whose information you enter into the Service.

You acknowledge and agree that you are solely responsible for:

• All childcare decisions: Any and all decisions regarding your child's health, safety, and wellbeing
• Medical care: Seeking appropriate professional medical care when needed
• Data accuracy: Verifying the accuracy and completeness of all data entered
• Professional consultation: Consulting with qualified healthcare providers for medical guidance
• Emergency response: Taking appropriate action in emergency situations
• Compliance: Complying with all applicable laws and regulations

Prohibited Uses: You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Service.

You agree to defend, indemnify, and hold harmless CareCub, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

• Your use of the Service or any medical decisions made based on app data
• Your violation of these Terms or any applicable law
• Your violation of any rights of another party
• Any content you submit, post, or transmit through the Service
• Any harm to your child or others related to your use of the Service

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Violation of applicable laws or regulations
• Fraudulent, abusive, or harmful behavior
• At our sole discretion for any reason

Upon termination, your right to use the Service will cease immediately. All provisions that should survive termination shall survive, including liability limitations and indemnification.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with applicable international commercial law and the laws of the jurisdiction where the service is primarily operated. Any legal action or proceeding arising under these Terms will be subject to binding arbitration as specified in Section 7 above.

International Users: If you are accessing the Service from outside the primary jurisdiction of operation, you acknowledge that these Terms remain binding and that any disputes will be resolved through the arbitration process outlined herein, conducted in English and accessible via remote proceedings when necessary.
